EULA - End User License Agreement

1. This license agreement is between the end user (you), a natural or legal person, and SoftLab LLC (referred to subsequently as the Rightsholder), which is the owner of exclusive proprietary copyrights in the software product 'Quick Maintenance Backup for MS SQL' (the Program).

2. In accordance with the terms of this agreement, the Rightsholder hereby grants the User the right, unrestricted by territory, non-exclusive, non-transferable (without the right to subsequently transfer the license/right), to use the copy of the Program provided together with this agreement.

3. By installing, copying, or otherwise using this software, you accept the terms of this agreement. Otherwise, you have no right to use this software and must delete it.

4. TERMS OF DISTRIBUTION AND LICENSING OPTIONS
4.1. This program is distributed as shareware. You may freely distribute the trial version of the Program without making any changes to the code or to the complete Program.
4.2. Licensing of the Program is carried out through SQL servers. The program's initial SQL server registration establishes a 30-day trial license. At the end of the trial period (30 days), the User must either acquire an activation key (commercial license), or continue to use the free version for SQL Express with limited functionality.

5. USE OF A COMMERCIAL LICENSE
5.1. Acquiring an activation key (License) grants the User the right to use the program with full functionality on one SQL server.
5.2. If several instances of SQL Server are installed on a computer, then the License gives the right to use all the instances on that computer.
5.3. If the ones registered in the SQL server program are deployed on virtual machines, then a separate License (activation key) must be acquired for each virtual machine.
5.4. The Rightsholder may at any time and without prior notice revoke the license in the event that a user violates the terms of this agreement.

6. USING THE FREE VERSION
6.1. The User has the right to use the program for free to serve databases on Microsoft SQL Express-edition servers with restrictions to the Program's functionality. The list of restrictions is shown on the website http://qmbsql.com

7. SUPPORT AND SERVICE
7.1. Support for the Program takes place online. The address for support (in English Russian) is support@qmbsql.com.
7.2. Support for the free versions is not guaranteed.
7.3. Users of the commercial version can install all Program updates, including new versions, for one year from time of purchase of the License (activation key). To upgrade to a later version, you must renew support.

8. DISCLAIMER
8.1. The program is delivered 'as is.' The Rightsholder does not guarantee that the Program is without errors, and assumes no responsibility for direct or indirect consequences from the use of or inability to use the Program, including for consequences that may arise due to possible errors in the Program's operation.
8.2. The Rightsholder's liability for possible losses incurred for any reason by you or by a third party cannot exceed the price you paid for the Program's License, if the use or inability to use it has caused actual damage or is the subject of a lawsuit. The Rightsholder bears no liability for loss of data, profits, savings, nor for damage to hardware, networks, or other consequences or accidents (even if the Rightsholder was informed about such a possibility), nor for claims brought by you on the basis of claims from a third party.
8.3. The Program is provided 'AS IS,' in accordance with generally accepted principles in international practice. This means that the Rightsholder does not bear liability for problems arising from the use of a copy of the software by you (including issues of compatibility with other software products (packages, drivers, etc.)), problems arising due to ambiguous interpretation by you of information relating to the software, data loss, non-conformity of the software's outputs to your expectations, etc.).

9. OTHER RIGHTS
9.1. The User does not have the right to decompile the Program, reveal its technology, otherwise influence the program, distribute activation keys, etc.
9.2. The user can not include the Program in other programs or systems, or alter, delete, or conceal trademarks or copyright notices.
9.3. The Rightsholder can collect information used for improving the Program and its support, and for identifying breaches of this license agreement. The Program can send this information to our servers over the Internet. This information is completely anonymous and not associated with any particular User. The program does not send any information about logins, passwords, databases, email addresses, IP addresses or any other confidential details.

9.4. The Rightsholder has the right to make changes to the license agreement at its own discretion, without advance notice to the User.
